A federal appeals court on Thursday temporarily stayed a House Judiciary Committee subpoena seeking testimony from a former Manhattan prosecutor involved in the criminal investigation of former President Donald Trump.
The order by New York’s Second Circuit Court of Appeals came just hours before former prosecutor Mark Pomerantz was instructed by a federal judge to sit down for a deposition before the commission.
Manhattan District Attorney Alvin Bragg’s office is filing an unprecedented criminal case against former Republican president and current leading presidential candidate Trump for falsification of business records. Trump has pleaded not guilty to charges related to paying hush money to two women who allege they had affairs with Trump before the 2016 election.
The Republican-controlled House Judiciary Committee, led by Rep. Jim Jordan of Ohio, said it had launched an investigation into Bragg’s case and was looking into whether the charges were politically motivated.
The commission served the subpoena to Mr. Pomerantz, who resigned from the prosecutor’s office a few months after Mr. Bragg took office in January 2022. Pomerantz worked under Bragg’s predecessor, Cyrus Vance Jr., on the agency’s investigation into Trump. It was “beyond doubt” that Trump committed the crime, questioning Bragg’s apparent decision at the time to suspend the investigation into Trump.
In response to a subpoena to Pomerantz, Bragg sued the Judiciary Commission to try to prevent the former prosecutor from testifying. I have no authority,” he said.
U.S. District Court Judge Mary Kay Viskosil, a Trump presidential candidate, denied on Wednesday that Mr. Bragg tried to revoke Pomerantz’s subpoena.
“The subpoena was issued with a ‘valid legislative purpose’ related to Congress’ ‘extensive’ and ‘essential’ power to ‘investigate,'” Viskosil said in federal court in Manhattan. .
“Mr. Pomerantz must appear for congressional depositions. No one is above the law,” the judge wrote.
