Supreme Court hears petition challenging order passed by Calcutta High Court Judge Abhijit Gangopadhyay directing him to CBI and ED to question TMC’s National Secretary Abhishek Banerjee in primary teacher recruitment fraud case When he did so, he verbally said: Judges did not have the right to be interviewed for television on pending issues. This problem, CJI DY Chandrachud and Justice PS Narasimha.
At its last hearing, the Supreme Court ordered the stay of all lawsuits against Banerjee as directed by Justice Gangopadhyay. Today Senior Lawyer Abhishek Manu Singhvi appeared for Banerjee and asked the court to take into account Judge Gangopadhyay’s interview with his ABP Ananda. Singhvi argued that:
“With the utmost respect and humility, you cannot do this…this was said in the presence of a lawyer. Not a single judge has clarified or revoked the statement.“
After reading the statement, CJI DY Chandrachud, while dictating the order, sought clarification as to whether the alleged statement was made by a single judge. The court ordered-
“The petitioner has attached a translated transcript of an interview with Justice Abhijit Gangopadhyay on ABP Ananda’s television channel. Calcutta HC’s Registrar General has been directed by the judge to clarify whether he has been interviewed by Mr. Sumande. The Registrar has been instructed to file affidavits with this court by Friday. I will list it on Friday.“
CJI DY Chandrachud verbally said while leaving on order that the court had not yet considered the merits but it was important to know whether Justice Gangopadhyay had authorized the interview. –
“I just want to say that the Judge has no business granting interviews about pending issues. Mm. The question is whether the judge who made such a statement about a politician can attend the hearing. Some process is required.“
