Dingus Khan, who formed Manningtree and are now staples of the Colchester music scene, were expecting their track My New Hat to drop on Spotify and Apple Music on March 17. .
Despite timely submission of the song and accompanying artwork to digital distributor TuneCore, the track did not appear on either service.
The band’s record label, Antigen Records, was then contacted by the American company, who explained that the cover art was too filthy and violated their guidelines.
The rejected image is a still from the promotional video for the single, showing bassist Tom Armstrong in underwear wearing a cowboy hat and sunglasses.
In their defense, Dingus Khan now cites Roxy Music’s Country Life album.
“We remain perplexed by this decision and it has caused outrage from some of our fans,” added frontman and songwriter Benjamin Brown.
“One of them sent me the Country Life album cover and said it was ‘obvious discrimination based on the physical quality in question’.

“TuneCore’s content review team claimed that the original artwork was too explicit to be distributed to online streaming platforms.
“They then asked our record label to submit new or censored artwork.”
Dingus Khan has said he turned the fiasco into something positive and created a contest where fans are asked to create and submit new artwork ideas.
The winner will receive a t-shirt equal to one month’s streaming earnings of the single and two tickets to the show on April 29th at the Colchester Arts Center.
Antigen Records’ Jason Whittaker said:
“Dingus Khan has been on virtual hiatus since March 2020, when Bernie was first diagnosed with leukemia and hospitalized.
“They didn’t want to play live while he was too ill to perform, but before he died he made it very clear that he wanted the band to continue.”
