(CNN) The Supreme Court will uphold the conviction of a Louisiana inmate who was convicted of murder and sentenced to death for his role in an attempted jailbreak involving five other inmates.
A judge on Monday declined to take up an appeal filed by inmate David Brown.
Judge Ketanji Brown-Jackson, along with her liberal colleagues Elena Kagan and Sonia Sotomayor, opposed the court’s decision not to try the case 6-3.
The state of Louisiana called on the court to dismiss Brown’s position, highlighting the gruesome nature of the murder of Captain David Knapps, who was beaten to death in a Louisiana State Penitentiary toilet during an escape attempt in 1999. They detained certain prison officers who they believed were unlikely to fight back, took their uniforms, dressed up as cops, and walked out of prison in cop uniforms. ”
Brown claimed he was part of a prison officer’s escape, but not a murder, and said the state covered up evidence that would have helped him. He said another inmate had confessed to committing the murder.
Brown had sought a lawsuit in Superior Court to find out whether the state violated Brady v. Maryland.
“We have repeatedly rejected lower courts, particularly the Louisiana courts, for their similar refusal to enforce their 14th Amendment obligation to disclose to the defense pretrial any favorable and material evidence in the possession of the government. Overturned,” Jackson wrote in dissenting opinion.
In the case, the Louisiana Supreme Court said Brady was not violated for not disclosing the confession because the other inmates who confessed never said Brown did not exist.
